Certification substituting declaration – SELF-CERTIFICATION

DESCRIPTION

The declaration substituting certification (dichiarazione sostitutiva di certificazione) (art. 46 It. Pres. Decree No. 445 of 28 Dec. 2000) is a declaration that the applicant may submit to public bodies, and public service management or provider companies (e.g. TRENTA, Postal services, Train services, Atesina, etc.) and to private individuals.
The declaration may contain information on the following status, facts, and personal information:

  1. date and place of birth;
  2. residing address;
  3. citizenship;
  4. civil and political rights;
  5. unmarried, married, widowed, single status;
  6. family status;
  7. alive/dead status;
  8. birth of a child;
  9. death of spouse, or family members;
  10. fulfilment of military service obligations including data reported on service records;
  11. inscription on registers and lists edited by public bodies;
  12. membership of professional bodies;
  13. educational qualifications;
  14. professional qualifications;
  15. exams sat;
  16. specializations, qualifications, training, further education and technical qualifications;
  17. income and financial status, also for the granting of benefits of any type as prescribed by special laws;
  18. tax payment, specifying the amounts paid;
  19. tax’s payer code possession and number, VAT number, and any other data registered at the Tax Office;
  20. unemployment status;
  21. retirement status and pension category;
  22. student status;
  23. status of legal representative of persons or companies, guardian, or similar;
  24. membership to any social association/club;
  25. no criminal record and never been charged or cautioned, no civil court judgements or administrative provisions filed at the criminal records office in compliance with the laws in force;
  26. as far as declarant is aware to not be under investigation by police/court authorities;
  27. to be responsible for dependents;
  28. all data known by the declaring party as filed in the registry office records;
  29. not to be in a state of liquidation of assets or insolvency and not to have submitted any application for bankruptcy.


The declaration must be signed in the presence of the public administration official appointed thereto, with no requirement for signature authentication, or submitted pre-signed along with a non-authenticated copy of the ID card of the undersigning party.

Any status or fact  not included in the list above may be declared by means of a declaration substituting the attested affidavit, signed by the declaring party (Art. 47 It. Pres. Decree No. 445 of 28 Dec. 2000).

The declarations substituting the attested affidavit do not require signature authentication if they are submitted to public administration bodies or public services management or provider companies. These declarations must be signed in the presence of official appointed thereto, or submitted pre-signed along with a non-authenticated copy of the ID card of the undersigning party (Art. 38, par. III, . Pres. Decree No. 445 of 28 Dec. 2000).

The following documents can not be substituted by self-declarations:


CONCERNED PARTIES

Anyone who must provide certifiable information to public bodies, or public services management companies or private individuals.

NOTES

Public bodies and public services management companies are prohibited from demanding  documents or certificates reporting the status, facts and personal  information as listed above. The declaration substituting certification (dichiarazione sostitutiva di certificazione), which, contrary to the usual certificate, is exempt from stamp duty, must be accepted ( as provided by law Art. 43 . It. Pres. Decree No. 445 of 28 Dec. 2000).
The non-acceptance of a self-declaration is a contravention of the laws in force.
Public bodies are obliged to carry out specific controls, at random, on the validity/veracity of the declarations submitted by citizens.
Should the control reveal that the declaration submitted is not true, the declaring party loses any benefit granted following his/her declaration and is subject to prosecution as prescribed by the law (Art. 76 It. . Pres. Decree No. 445 of 28 Dec. 2000).
